    City of Mansfield


    The City of Mansfield has enacted a Stormwater Management Ordinance for the purpose of establishing feasible and economically reasonable standards to achieve a level of management and conservation practices which will abate erosion of the soil and abate the degradation of the waters of the State by soil sediment in conjunction with nonfarm, earth-disturbing activities. The City of Mansfield is the permitting authority for all land disturbing activities and requires the land owner to maintain all on-site stormwater control facilities and all open space areas (e.g. parks or “green” areas) required by the approved stormwater control plan. The City of Mansfield will only provide construction permits to projects that establish a plan to manage stormwater runoff occurring during the construction process. The City of Mansfield, under the NPDES program, also has the authority to inspect properties for noncompliance and can issue a notice of violation (NOV) for any deficiency or infraction onsite. Property owners are responsible for the maintenance of any stormwater facilities or practices located on the property. The City of Mansfield has the authority to inspect stormwater facilities and practices in order to ascertain that they properly maintained and functioning.

    MAINTENANCE OF STORMWATER DRAINAGE FACILITIES AND CONTROL STRUCTURES.

    When stormwater drainage facilities and control structures are of a permanent nature, the City may assume responsibility for such structures located within the corporation limits once they have been constructed and accepted by the City.  Funding for the maintenance of these major facilities may be by assessment of property owners in accordance with the Ohio Revised Code.  The maintenance of minor detention areas such as swales, etc. on individual parcels or lots in new subdivisions shall be the responsibility of the individual parcel or lot owners.  Special provisions shall be written into the deeds for the individual parcels, or lots in new subdivisions, so the owners are aware that the parcels or lots are used for temporary storm water storage.  The City shall require all of these stormwater drainage facilities and control structures to be designed to minimize maintenance costs.

    PROPERTY OWNER TO PROVIDE EASEMENTS AND RIGHTS RIGHTS OF WAY.

    The property owner or owners shall provide all necessary easements and rights of way to the City in order to permit the maintenance and repair of the required stormwater drainage facilities and control structures.

    PENALTY.

    Violation of the provisions of this chapter or failure to comply with any of its requirements shall constitute a minor misdemeanor.  Whoever violates any provision of this chapter or fails to comply with any of its requirements shall be fined not more than one hundred dollars ($100.00) for each offense.  Each day such violation continues shall be considered a separate offense.  Nothing herein contained shall prevent the City from taking such other lawful action as is necessary to prevent or remedy any violation.
